Legal Opus

Post Graduate Department  of Shri Dharmasthala Manjunatheshwara Law College & Centre for Postgraduate Studies and Research in Law, Mangaluru, invites submissions for the 15th issue of Legal Opus. Legal Opus is a Peer Reviewed Annual Law Journal of our institution for enabling the academicians, legal professionals, activists, Judges, Jurists and students to publish their research papers. Legal Opus is a refereed Journal.

Research papers are invited for publication every year. Articles submitted for publication are subjected to Peer Review by a panel of experts comprising of pioneering jurists and eminent academicians acting as blind referees to ensure that the articles submitted for publication adhere to the minimum standard in terms of methodology, theory and content.

Summary of the event / Additional information:
This was another talk given by two students as a part of the Unit’s Study Session Series of Talks. The format of the session was as follows: The session was in the form of a discussion led by two of R&P Unit’s own members – Shwetha Pai and Swathi Baliga. This was followed by a “Question Hour” segment where they responded to queries of the students.Some points discussed included: Company Secretary is a very demanding course. Combining it with law, CS has the potential to unlock the doors to the corporate world. The scope of CS is tremendous due to the increase in the need for a compliance department in companies. This course gives the opportunity to students from the non- commerce background too. It mainly deals with corporate and secretarial laws. The levels of CS Exam were explained and the syllabus elaborated on.

Summary of the event / Additional information:

R&P Unit convened an introductory meeting as an ice-breaker for the 12 selected participants of our Research Training Program. The meeting started with the preliminary introductions of the participants. This was followed by giving them an insight into the program on three main points:
•Why we’re doing this
•What they can expect from us
•What we expect from them

After learning about what the program would entail, the participants were given a rough idea on the commitment that is expected from them.Dr.Gagan then moved on to explain the Research Theory part of the session where he briefed them on various aspects of research like:
•Why do we do research?
•Man, curiosity and problem
•Research vs superstition
•Scientific research
•Doctrinal vs empirical
•Collection of data
•Analysis of data
•Writing the paper

He especially spoke about the concept of “Empirical Research” at length.

Summary of the event / Additional information:
This was part of the Study Session Series of Talks organised by the Unit where final year students are called as resource persons to share their experience and provide tips. This particular session was for the third year BA LLB (B Section) students on ‘How to Tackle Law Exams’ as conducted KSLU, by the Secretary of the student Executive Council – SauravShet.Emphasis was given on the methods of studying and preparing notes with class points, time allotment to each answer and the techniques to be used to score well. Question: A special prize for those who can say something meaningful about the collage of these two photos.

Answer: The person to the left is Justice Hans Raj Khanna who gave the dissenting judgment in the Habeas Corpus Case (ADM Jabalpur v. Shivkant Shukla). The person to the right in the collage is Justice DY Chandrachud who has given a dissenting judgment in the Aadhar case, by stating that it violates the fundamental rights. Both are great dissenters who have protected the Fundamental Rights through their dissents.

Essay Competition: My Struggle with the Truth

Summary of the event / Additional information:
The Unit organized an essay competition on account of Gandhi Jayanthi to be celebrated on 2nd October. The broad theme for the essays was “My Struggle With the Truth” which is inspired by Mahatma Gandhi’s autobiography titles “My Experiments with Truth.” The competition was open to all. The contestants were given 1 hour to write their essay. The contestants were given the liberty to interpret the said theme in any way they chose to. Totally 8 students participated in the competition. The evaluation of the English essays has been done by Mr. Mahesh Chandra Nayak and Mrs. Ujwala. The Kannada essays have been evaluated by Mr. Naresh Malligemadu. The event was organised by Aditya D’Mello. The best of these essays will be published in the college magazine – Pragathi.

Summary of the event / Additional information:
A talk on “Startups and the Law” was organised for all the second year BBA LLB students. “A startup is a company working to solve a problem where the solution is not obvious and success is not guaranteed,” says Neil Blumenthal, cofounder and co-CEO of Warby Parker. Startups help in innovation, creating jobs, new products and Services and bring profits for investors. The study focused on the legal aspects like – business organisation, tax matters, contracts and labour issues with respect to startups. SathyaSagar Mithra and SwathiBaliga helped in organising the talk. This was done in collaboration with Ms. PrekshaMayadi (Assistant Professor, SDMLC).

Summary of the event / Additional information:
The Karnataka State Law University (KSLU), Hubbali to which SDMLC is affiliated has introduced internal assessment from the current academic year. Writing assignments therefore, has become an integral part of the course work. But, first year students are often lost when it comes to such an exercise because they are unfamiliar with the format in which the assignments have to be submitted and also have very little idea about the topics assigned.With this in mind, the Unit thought it best to conduct a brief session to give an overview of how to write assignments. The session was tailor-made for the first year BBA students by giving them comparative ideas of how to deal with topics that are purely related to Business Administration and those that are related to law. Special emphasis was given to the concept of case analysis. The session was held with an intention to emphasize on the importance of research for law students. A general overview of research and legal research, more specifically was given. The idea of research often invokes a mixed response of fear and intimidation. The goal therefore, was to introduce the concept of research to the freshers by eliminating all misconceptions associated with it and to ensure that they perceive it more favorably. Various aspects of research were touched upon including addressing concepts such as reflective thinking, identifying a research problem, understanding hypothesis, objectives of research, research writing, citation rules and so on.In addition to this, the practical application of legal research was also talked about. The target audience for the session was all 1st BA LLB students.
